Kenny’s wife is jumping for joy right now. Since he died before going to trial, the judge in the case was forced to accede “to decades of legal precedent” and wipe all 10 criminal charges from his record. Judge Revokes Lay’s Conviction (Washington Post) has the gory details.

“Legal analysts said Lake’s ruling closely hewed to a long-held doctrine called abatement, which allows a conviction to be vacated if defendants die before they are able to exercise their right to appeal. Courts typically rule that defendants’ constitutional rights to challenge their convictions outweigh other considerations, and the law hesitates to punish the dead, the analysts said.”

I feel a rousing chorus of The Star Spangled Banner coming on. Is that a tear? I believe that it is. The estate of Kenny Lay is not legally obligated in any way to give the criminally obtained booty back to the pensioners of the former Enron Corporation. Jeffrey Skilling is unfortunate enough to be alive, so all eyes are on him now, as “federal prosecutors are seeking to hold Skilling responsible for Lay’s share, over Skilling’s objections.” No kidding? He’s objecting? He probably has nothing to be afraid of, as there’s a good chance Kenny Boy’s wife and kids will simply return the 44 million their husband and father absconded with.

I wonder why that rather obvious solution wasn’t mentioned? Don’t they believe that Frau Lay will come to the same conclusion?
